These Terms and Conditions ("Terms") govern your use of the Brick Memory website (the "Site") and your purchase of products offered by Brick Memory ("we", "us", "our"). By accessing this Site and/or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Site.

1. Custom Products and Customer Content

  • All customized products are produced based on customer-provided inputs, including but not limited to names, colors, text, and messages.
  • It is the customer's sole responsibility to ensure the accuracy, legality, and completeness of all customization information submitted.
  • We reserve the right to reject, modify, or request edits to any submitted content deemed inappropriate, offensive, infringing, or unlawful.
  • By submitting content for customization, you confirm that you hold the necessary rights and permissions to use such content and grant us a non-exclusive license to reproduce it solely for the purposes of fulfilling your order.

2. Intellectual Property

  • All designs, layouts, printed elements, packaging artwork, website content, and images created by Brick Memory are the sole intellectual property of Brick Memory and may not be copied, reproduced, or distributed without our written permission.
  • Customer-provided content remains the intellectual property of the customer, but we retain the right to use it exclusively for production and record-keeping purposes.

3. Orders and Acceptance

  • All orders placed on this Site are subject to our acceptance. We reserve the right to cancel or refuse any order at our sole discretion, including but not limited to suspected fraud, violation of intellectual property rights, or unavailability of components.
  • Order confirmation emails serve as acknowledgment of receipt but do not constitute legal acceptance of the order.

4. Pricing and Payment

  • All prices are listed in United States Dollars (USD) unless otherwise indicated.
  • Prices are subject to change without notice. Taxes and shipping fees, where applicable, will be calculated at checkout.
  • We accept payment via authorized online payment processors. Payment must be received in full before production begins.

5. Production and Delivery

  • Production time for made-to-order products is typically 2–3 business days but may vary based on order volume and customization complexity.
  • Shipping times are estimates and do not include production time. We are not responsible for delays caused by shipping carriers or events beyond our control.
  • Customers are responsible for providing accurate shipping information. Orders returned due to incorrect addresses may be subject to additional shipping fees.

6. Returns, Refunds, and Replacements

  • Customized products are non-refundable and non-returnable, except in the case of manufacturing defects or fulfillment errors.
  • Non-custom products may be returned within 14 calendar days of receipt, provided they are unused and in original packaging. Return shipping costs are the customer's responsibility.
  • If your item arrives damaged or incorrect, you must notify us within 7 calendar days of delivery with photographic evidence. We reserve the right to offer a replacement or refund at our discretion.

7. Limitation of Liability

  • To the fullest extent permitted by law, Brick Memory shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our Site or products.
  • In no event shall our total liability to you exceed the amount paid for the specific order giving rise to the claim.

8. Product Safety

  • Our products are intended as collectible items and may contain small parts. They are not recommended for children under 12 years of age unless otherwise stated.
  • Customers are responsible for ensuring appropriate use and safe handling of all components.

9. Trademarks and Third-Party Rights

  • LEGO® is a registered trademark of the LEGO Group. Brick Memory is not affiliated with, sponsored by, or endorsed by the LEGO Group.
  • We use a combination of genuine LEGO® bricks and compatible third-party parts to create independently designed products.
  • Any third-party names, logos, or references used for customization must be legally authorized by the customer. We do not assume liability for trademark infringement arising from user-submitted content.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New York County, New York.
